If you or your baby are showing any symptoms of Covid-19, or have been in close contact with anyone who has tested positive PLEASE DO NOT ATTEND CLASS and treat it as you would any other communicable disease e.g chickenpox/ measles by stayng at home and avoid mixing with others.
. HOW TO BOOK
You can book a Bright Sparks class through our online booking system by adding the chosen class to your basket and making payment in accordance with these terms and conditions.
By placing a booking request you are confirming that you are at least 18 years old. If you are under 18 years old you are not permitted to place a booking request via this site.
When completing a booking you must provide us with complete and accurate payment information.
Where the person (referred to as “you” in these terms and conditions) making the booking is not the person who will be accompanying and having care and control of the child attending the booked Bright Sparks class (the carer), you are responsible for ensuring that the carer has read and complies with these terms and conditions and you are responsible for the carer’s behaviour and any breach of these terms and conditions by the carer.
By booking you also accept we may pass on your details to the NHS Track and Trace System where there is a legal obligation to do so.
If we are unable to accept your booking request for any reason, we will inform you and no contract will be formed between you and Bright Sparks. In these circumstances you will not be charged or, if you have already paid for the booked Bright Sparks class you will be refunded the amount paid by you.
Prices are inclusive of VAT (where VAT applies).
. OUR RIGHTS TO MAKE CHANGES
We may have to occasionally change the Bright Sparks experience to reflect changes in relevant laws, health and safety requirements (including any social distancing requirements or guidelines) and regulatory requirements.
. CAN YOU CHANGE YOUR BOOKING?
If you wish to make a change to the time, date or venue of your class or your enrolment with Bright Sparks more generally, please contact us as soon as possible. You will be informed if the change is possible.
If it is possible, you will be notified about any changes to the pricing, the timing of supply or anything else which would be necessary as a result of your requested change and you will be requested to confirm whether you wish to go ahead with the change.
If the requested change cannot be made or the consequences of making the change are unacceptable to you, you may want to end the contract. However where we are not at fault and you are not within the cancellation period a deduction may be made from any refund due to you, to compensate for the loss incurred as a result.
In order to change or cancel your booking, 48 hours notice is required. If less than 48 hours notice is given, you are welcome to gift your space to a friend instead, however regreattbly refunds/ class transfers cannot be issued.
. PAYMENT
Payment is due in full upon placing your booking with Bright Sparks.
Payments taken for a term are non-refundable except in accordance with these terms and conditions.
If we do not receive payments when due or any payment authorisation is cancelled by you (except in accordance with these terms and conditions) we may immediately terminate or suspend your enrolment with Bright Sparks including attendance at classes and you must pay us the sums that you owe outstanding.
. YOUR RIGHT TO CANCEL
Please allow 2 working days to cancel if you have changed your mind or cannot attend your booked class. Cancellations must be made in writing by using the contact form on our website. Any classes which are cancelled less than 2 working days prior to when your class is scheduled for, will incur the full class charge and is regrettably non refundable. In this instance you are welcome to send a friend in your place.
. REFUNDS
Any refunds due to you will be made as soon as reasonably possible.
. EVENTS OUTSIDE OF OUR CONTROL
If all or any part of any Bright Sparks experiences at a venue has to be suspended or delayed by an event outside of our control, for example: teacher illness or absence, exceptionally bad weather, unavailability of the venue, widespread illness or lockdown measures being imposed, you will be contacted as soon as possible (usually by either email or text message) to let you know. In these circumstances we have the right to:
Where such substitution or alternative offering has been made then we will not be liable and no discount or refund will be available for any such substitution or re-scheduled event.
If however there is a risk of substantial delay to the Bright Sparks classes re-commencing of more than 28 days due to lockdown and no substitution can be offered, you have the choice to receive a refund for any classes you have paid for but which have not yet been performed.
. YOUR RESPONSIBILITY
You promise and represent to us that:
In the instance that you are unable to attend for any reason and you are not able to give more than 2 working days' notice, you may send a friend to class in your place.
If the child attending class will be accompanied either by you or your carer and will be under the direction, care and control of you or your carer at all times and that you or your carer are solely responsible for his or her welfare and conduct at the venue;
. WE ARE NOT MEDICALLY TRAINED
Whilst we give you the option to provide us with information about your child’s health and needs generally, you acknowledge that we are not medically trained and are not qualified to assess whether you or your child is fit and well enough to take part. Please contact your GP if you are in any doubt before starting. Also if you or your child feels unwell before or during class , please let us know as soon as possible.
Please note we will record, process and keep your personal information secure in accordance with the DATA PROTECTION ACT 1998. We will not pass your information on to any third parties.
